By accessing or using BayPass Club ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time. Material changes will be posted on this page, and your continued use constitutes acceptance.
You must be at least 18 years old and capable of forming a legally binding contract to use BayPass Club. By creating an account, you represent and warrant that you meet these requirements. Accounts created by automated means or on behalf of another person without authorization are prohibited.
BayPass Club is a membership-based service that provides access to discounted ticket inventory for Bay Area attractions. Membership is not required to browse and purchase discounted tickets.
By registering as a member, you agree to receive emails from BayPass Club. This includes transactional messages such as ticket delivery confirmations and order updates, as well as member communications such as newsletters, exclusive offers, and attraction announcements. You may opt out of marketing emails at any time by clicking the unsubscribe link in any email, though transactional emails related to your account and orders cannot be opted out of.
All payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for membership fees and ticket purchases.
You may cancel your membership at any time from your account settings. Upon cancellation:
When you place a ticket order through BayPass Club:
You are only charged after your tickets have been issued and delivered to your email. Once your order is confirmed, we process it and send your tickets as soon as they are issued by our distribution partner. You can track real-time order status in your BayPass account.
If a BayPass-delivered ticket does not work at the attraction entry during your selected date/time window, we will either reissue a valid ticket or reimburse verified gate purchase costs. This guarantee does not cover:
You can cancel your order any time before your tickets are issued and delivered, and you will not be charged. Once tickets have been issued and delivered, they are typically non-refundable.

We reserve the right to suspend or terminate accounts that violate these terms without refund.
To the maximum extent permitted by law, BayPass Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to BayPass Club in the 12 months preceding the claim.
BayPass Club is an independent service and is not responsible for the policies, actions, or failures of third-party attractions, venues, or ticket vendors. We make no guarantees about attraction availability, hours, or experience quality.
Any disputes arising from these Terms or your use of BayPass Club shall first be resolved through good-faith negotiation. If informal resolution fails, disputes shall be resolved through binding arbitration administered by JAMS in San Francisco County, California. You agree to waive your right to participate in class-action lawsuits or class-wide arbitration. Small claims court actions are exempt from this arbitration provision.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in the state or federal courts located in San Francisco County, California.
